Sounds like two stories: (1) ODOT funding; and, (2) Administrative Procedures Act. I encourage you to withhold blaming NEPA & NHPA in the absence of a good understanding of how and when ODOT funded each aspect of the project.
I didn't read this article as blaming NEPA/NHPA. I think the author did a good job of showing what frustration they must have felt internally while trying to avoid unnecessary litigation and bad publicity.

An author wrote this a while back saying that the US isn't a democracy, it's a vetocracy. The 1% or even the individual can veto anything.
